Policy and Operating Instruction PROHIBITION AGAINST HARASSMENT HR Policy 3.3 POLICY Martin Marietta will not tolerate harassment of a sexual, racial, ethnic, religious, or other nature. The Company is committed to providing a professional work environment for its employees that is free of physical, psychological and verbal harassment. DEFINITIONS Harassment - Offensive behavior that intimidates, torments, annoys or threatens a person on any basis including age, ancestry, color, disability, national origin, race/ethnicity, religion/creed, sex, gender, military or veteran status or other factor. Sexual Harassment - Any unwelcome sexual advances, requests for sexual favors or other unwelcome verbal or physical conduct of a sexual nature. Sexual harassment exists when any one or more of the following occurs: Integrity Leadership 2017 27 | P a g e - Submission to the sexual conduct is a term or condition of employment, - Employment decisions are based upon whether or not a person submits to sexual conduct, - The sexual conduct has the purpose or effect of interfering with a person's work, or - The sexual conduct creates an intimidating, hostile, abusive, or offensive work environment. PROHIBITED CONDUCT A. Prohibited verbal conduct includes, but is not limited to: - Profanity, offensive language, name calling, or names or labels that another person can reasonably be expected to find offensive. - Verbal threats, blackmail, extortion, threatening calls. - Racial slurs, ethnic jokes or comments that demean a race, ethnic group, cultural background or other personal characteristics.
