It also sought to bar what it called “unlawful changes to the covenants and restrictions related to TSI’s development (i.e. allowing for road access).” The plaintiff also alleged an overreach and “self-dealing” by BGIPOA board members in, among other things, agreeing to authorize 5F to construct a roadway to TSI “for use by the Strich-owned lots … and not the lots owned by Osprey Alley, LLC, Redfish Alley, LLC, or Three Sisters Isle, LLC …” Finally, the plaintiff alleged the same overreach by Three Sisters Homeowners’ Association directors Ron Strich, Chris Johnson, and Jeff Deaterly, accusing them of enabling Strich “to extort money for access to the lots owned by plaintiffs …” Defendants began to answer accusations made against them in a new lawsuit over access to Three Sisters Island. The lawsuit was filed almost immediately after the resolution of decades’ worth Boca Grande Bayou of acrimonious dispute; but the plaintiff in the new suit argued that the settlement agreement was illegitimate for various reasons, including a court order regarding the use of lots in BGI; the means by which the settlement was approved by each island’s homeowners’ association; and the terms of the agreement itself, which allegedly benefit some homeowners more than others. That suit contained allegations that homeowners on BGI and TSI, as well as respective homeowners’ associations, BGIPOA and TSIHA, and their directors, were remiss in fiduciary duties to certain property owners when they agreed to allow TSI property owners to build a road and bridge to connect the islands formally. The plaintiffs in the case owned lots on BGI and TSI, and were accused by the BGIPOA of illegitimately altering its declaration of restrictions to allow lot 99 to be used for a roadway. In the course of that alteration to the agreement, the complaint alleged, the directors of BGIPOA engaged in self-dealing by accepting, in return, a payment of $3 million and an annual assessment, July 24, 2015:
