11. TOBACCO, ALTERNATIVE NICOTINE, OR VAPOR PRODUCT USE BY STUDENTS / Board Policy 09.4232
Students shall not be permitted to use or possess any tobacco product, alternative nicotine product, or vapor product as defined
in KRS 438.305 on or in all Board property at all times, including any vehicle, owned, operated, leased, or contracted for use
by the Board and while attending or participating in any school-related student trip or student activity. This includes tobaccorelated
paraphernalia (i.e., lighters, electronic cigarettes, matches, tobacco containers), including tobacco- free tobacco replacement
products. Levels 1-4. Actions may result in charges being filed with the court system and/or being reported to legal and/or
social authorities.
12. GAMBLING
Participating in games of chance for the express purpose of exchanging money or items of value. (Level 1/Level 2) Actions
may result in charges being filed with the court system and/or being reported to legal and/or social authorities.
13. MENACING (KRS 508.050)
A person is guilty of menacing when he intentionally places another person in reasonable apprehension of imminent
physical injury. (Level 1/Level 2) Actions may result in charges being filed with the court system and/or being reported to
legal and/or social authorities.
14. PHYSICALASSAULT (KRS 568.010-030)
Physical attack of one person or a group of persons upon one or more persons who do not wish to engage in the conflict. Any
provocation, verbal or physical, may be considered a mitigation of the charge. A person who finds himself the victim of an assault
has the right to defend himself against the attack and use such force in defense as to be reasonably necessary. (Level
2/Level 3/Level 4) Actions may result in charges being filed with the court system and/or being
reported to legal and/or social authorities.
15. BURGLARY (KRS 434B.1-020)
A person is guilty of burglary when:
A. With the intent to commit a crime, he knowingly enters or remains unlawfully:
(1) In a dwelling;
(2) In a building, and when in effecting entry or while in the building or in the immediate flight therefrom, he or another
participates in the crime with one or more of the following conditions existing:
(a) Is armed with explosives or a deadly weapon; or
(b) Causes physical injury to any person who is not a participant in the crime; or
(c) Uses or threatens the use of a dangerous instrument against any person who is not a participant in the crime;
B. With the intent to commit a crime, he knowingly enters or remains unlawfully in an inhabited building.
C. With the intent to commit a crime, he knowingly enters or remains unlawfully in an uninhabited building. (Level
3/Level 4) Actions may result in charges being filed with the court system and/or being reported to legal and/or social
authorities.
16. ROBBERY (KRS 515.020)
A person is guilty of robbery when, in the course of committing theft, he uses or threatens the immediate use of physical force
upon another person with intent to accomplish the theft. (Level 3/Level 4) Actions may result in charges being filed with the court
system and/or being reported to legal and/or social authorities.
17. VANDALISM
The unprovoked or willful destruction, defacing or marring of property located on school premises. Negligent - with
restitution or Intentional - with restitution (Level 1/Level 2/Level 3) Actions may result in charges being filed with the court
system and/or being reported to legal and/or social authorities. Parents shall be liable for property damage caused by their
minor children.
18. POSSESSION OF WEAPONS (KRS 527.070)
The possession of any instrument, such as fireworks, explosives, mace/pepper spray, knives, spikes, clubs, guns, chains and
the like that can be used to inflict bodily injury to another person. (Level 2/ Level 3 or 4) Actions may result in charges being
filed with the court system and/or being reported to legal and/or social authorities. Unlawful possession of a weapon on school
property in Kentucky is a felony punishable by a maximum of five (5) years in prison and a ten thousand dollar ($10,000) fine.
The Board of Education stresses that students are never allowed to bring a weapon to school. The Board urges parents and
other citizens to make sure that students do not have inappropriate access to weapons.
Both Board policy and the law prohibit the carrying, bringing, using, or possessing of any weapon or dangerous instrument
in any school building, on school grounds, in any school vehicle or at any school-sponsored activity. Except for authorized
