obtain, upon request, copies of the records transferred and an opportunity for a hearing. Parents shall have the right to
file complaints about the Family Education Rights and Privacy Act concerning any alleged failures of the district to
comply with this act.
Parents of a child who has graduated or otherwise left the district and who was formerly enrolled in a program for
exceptional children may request the destruction of any personally identifiable information in the education record
of their child which was collected, maintained, or used for the identification, evaluation, or placement of the exceptional
child. Such requests should be addressed in writing to the Director of Pupil Personnel.
The Knox County School District will presume that the parent has the authority to review and inspect records
relating to their children unless the district has been advised in writing that the parent does not have legal authority
under applicable state law governing such matters as guardianship, separation, and divorce.
Personally identifiable information is not released to another party unless there is written authorization from
the parent or eligible student, or there is a "legitimate educational interest" as defined in the policies and procedures
for confidentiality. A current list of employees' names and positions who have access to personally identifiable
information is on file in each school. The K.C.S.D. has described in its policies and procedures the conditions under
which personally identifiable information is released to another person without written parental consent.
Any parent or guardian of a student, or any eligible student, may challenge the content or accuracy of any
material or entries in the student's educational records on the grounds that it is inaccurate, misleading, or otherwise in
violation of the privacy or other rights of the student. Requests to amend the records are submitted to the principal of
your child's school.
For students who have a disability and have been determined eligible for special education services, the
K.C.S.D. will destroy the educational records and the due process folder three (3) years from the date of the last
activity.
Parents are advised that data contained in the records may be later needed for Social Security purposes. The
K.C.S.D. retains, for at least 2 years, a record of the student's name, address, telephone number, grades, attendance record,
classes attended, grades completed, and year completed.
Children and youth determined eligible for special education include those children and youth with disabilities, such as
developmentally delayed, hearing impairments, vision impairments, emotional and behavior disorders, both deafness and
blindness, health impairments, specific learning disabilities, mental disabilities, multiple disabilities, speech and language
impairments, physical disabilities, autism, or traumatic brain injuries, and who because of these impairments need specially

STUDENT RECORDS
Data and information about students shall be gathered to provide a sound basis for educational decisions and to enable
preparation of necessary reports.
PROCEDURE TO BE ESTABLISHED
The Superintendent shall establish procedures to promote effective notification of parents and eligible students of
their rights under the Family Education Rights and Privacy Act (FERPA) and to ensure District compliance with
applicable state and federal student record requirements.
DISCLOSURE OF RECORDS
Student records shall be made available for inspection and review to the parent(s) of a student or to an eligible
student on request. Eligible students are those 18 years of age or older or those duly enrolled in a post-secondary school
program. In general, FERPA rights pass to the eligible student upon either of those events. Parents may be provided
access to the educational records of an eligible student 18 years old or older if the student is dependent under federal tax
laws.
Foster children are to be immediately enrolled in a new school. The District shall collaborate with the Cabinet to
ensure immediate and appropriate enrollment of the child and immediately contact the student’s previous school for
relevant records. The previous school shall provide the new school records within the student information system
maintained by the Kentucky Department of Education by the end of the working day on the day of receipt of a request.
If a record provided to the new school is incomplete, the previous school shall provide the completed record within
three (3) working days of the original request. Remaining records shall be provided within ten (10) working days of the
request.
