Crime Victims Compensation Board
If you received your brain injury as a result of an assault or other
criminal act, you may be entitled to some compensation from the
Kentucky Crime Victims Compensation Board.
The Crime Victims Compensation Board is a state agency that
utilizes state and federal funds to reimburse unpaid medical and
hospital expenses, lost wages (up to $150 per week) and unpaid
funeral expenses (up to $5,000) for a victim of crime, the fund
is limited to $25,000 per victim for any combination of medical,
lost wages and funeral expenses; however, by statute, this amount
is reduced by the amount received from other sources such as
insurance, Medicaid, donations, contributions, etc. Psychological
counseling for a maximum of two years is also an eligible expense,
in cases where it is applicable.
Eligibility
Any person who is an innocent victim of a criminal act, including
victims of drunk drivers, who suffered bodily or psychological
injury or death, or who has lost earnings or support, as a result of
crime. The victim must report the crime to the proper authorities
within forty-eight (48) hours and cooperate with law enforcement
agencies.

Traumatic Brain Injury Trust Fund
The Traumatic Brain Injury Trust Fund is a service set up for
residents of Kentucky who need assistance with expenses and
services that occurred because of a brain injury. The benefit limit
is $15,000 per individual per year with a lifetime maximum of
$60,000.
Who is eligible?
Medical eligibility: People with a partial or total disability caused
by injury to the brain are eligible to receive support from TBI’s
Benefit Management Program. Injuries to the brain may be a
result of physical trauma, damage resulting from lack of oxygen,
allergic conditions, toxic substances and other medical incidents,
including damage caused by drug overdoses or alcohol poisoning.
Eligible individuals have impaired cognitive abilities or impaired
brain function. Individuals may be under 21 to apply for these
services.
Financial Eligibility
People with brain injury, and without viable funding sources
for needed services, are eligible to receive support from the
TBI Benefit Management Program. There are no caps on family
income levels used to screen services. However, since the TBI
Trust Fund is the payer of last resort; the applicant must have no
other viable funding source for needed services.
Exclusions
The following services cannot be covered under this program:
medications, institutionalization, hospitalization or services for
anyone who is a resident of an institution or hospital.
Services:
Case Management: case management services assist TBI Trust
Fund applicants in gaining access to TBI Trust Fund supports and
to other community based services; medical, social, education and
other services, regardless of the funding source.
Wrap-around Funds: can be used when the case management
services plan identifies a need for a special implement or service
that will greatly enhance the success of the person’s plan for
obtaining or maintaining community-based services.
Community Residential Services: services that include the
retraining and rehabilitation of the individual in the performance
of home care and home management tasks.
Structured Day Programs: programs the provide services directed
at the development and improvement of community living skills.
